1. Partner Visas

1. Subclass 820 & Subclass 801 (Onshore Partner Visa)

For applicants who are already in Australia at the time of application.

  • Subclass 820 – Temporary Partner Visa

  • Subclass 801 – Permanent Partner Visa

Key Features:

  • Apply while in Australia

  • Temporary visa (820) granted first

  • Permanent visa (801) assessed approximately 2 years after initial application

  • Full work rights

  • Access to Medicare

  • Include dependent children

Eligibility Requirements:

  • Genuine and continuing relationship

  • Married or in a de facto relationship (usually 12 months unless exempt)

  • Sponsor must be an Australian citizen, permanent resident, or eligible NZ citizen

  • Meet health and character requirements

2. Subclass 309 & Subclass 100 (Offshore Partner Visa)

For applicants applying from outside Australia.

  • Subclass 309 – Temporary Partner Visa

  • Subclass 100 – Permanent Partner Visa

Key Features:

  • Apply from outside Australia

  • Temporary visa (309) granted first

  • Permanent visa (100) granted after assessment period

  • Full work and study rights in Australia

3. Prospective Marriage Visa – Subclass 300

The Subclass 300 visa allows a fiancé(e) of an Australian citizen or permanent resident to enter Australia to marry their partner.

Key Features:

  • Valid for up to 9–15 months

  • Applicant must marry sponsor within visa validity

  • After marriage, eligible to apply for Subclass 820/801

  • Work rights in Australia

Requirements:

  • Genuine intention to marry

  • Have met in person since turning 18

  • Genuine relationship

2. Parent Visas

Common Parent Visa Categories:

  • Contributory Parent Visas (Subclass 143 & 173) – Faster processing, higher visa application charges

  • Non-Contributory Parent Visas (Subclass 103) – Lower cost, significantly longer processing times

  • Aged Parent Visas – For parents old enough to receive the Australian Age Pension


Key Requirements:

  • Pass the Balance of Family Test

  • Assurance of Support required

  • Sponsored by an eligible child

3. Child Visas

Main Child Visa Options:

  • Subclass 101 – Child (Offshore)

  • Subclass 802 – Child (Onshore)

  • Subclass 445 – Dependent Child (temporary)

Eligibility Includes:

  • Biological, adopted, or stepchildren

  • Generally, under 18 years old (or financially dependent if older)

  • Must be single
